Terms and Conditions
The short version
This page tells you who runs this website and on what terms you may use it. Browsing is free and asks nothing of you.
Nothing on this site is a binding offer. If we end up working together, the price, the scope and the timeline are the ones written into the proposal you sign, and that document governs the work rather than this one.
1. Who runs this website

2. What these terms cover
These terms govern your access to and use of horizonsymmetry.com and its subdomains, including the project enquiry funnel at apply.horizonsymmetry.com. By using the site you accept them. If you do not, please stop using it.
They are not the contract for our services. Any work we do for a client is governed by a separate written proposal or agreement setting out scope, price, timeline, revisions, payment terms and ownership. Where that document and this page disagree, that document wins.
3. Nothing here is an offer
The descriptions of services, the case studies and any figures shown on this site are there to explain what we do. They are an invitation to talk, not a binding offer under article 1262 of the Spanish Civil Code, and no contract is formed by sending us an enquiry or by us receiving one. We are free to decline a project, and you are free to walk away, at any point before a proposal is signed by both sides.
Booking a call through this site reserves a conversation and nothing more.
4. Using the site
You agree not to:
- use the site for anything unlawful, or in a way that infringes someone else's rights;
- attempt to gain unauthorised access to it, to the servers behind it, or to any connected system;
- interfere with it, overload it, or introduce anything malicious into it;
- scrape, copy or systematically extract its content, whether by automated means or by hand, beyond what normal browsing requires;
- submit false information through the enquiry form, or somebody else's personal data without their permission.
We may restrict access to anyone who does any of the above, without notice.
5. Intellectual property
The site itself
The design, code, layout, animations, text, structure and arrangement of this website belong to Zencup, S.L. or are used under licence. The Horizon Symmetry name and mark are ours. None of it may be reproduced, adapted, republished or used to train an automated system without our written permission. Linking to the site is welcome and needs no permission at all.
The work shown in the portfolio
The case studies show work produced for clients. Client names, logos, brand marks and photography remain the property of the client concerned, and are shown here to identify and illustrate work we carried out. If you are a rights holder and you believe something on this site is used without a proper basis, write to horizonsymmetrystudio@gmail.com and we will review it promptly and take it down if you are right.
Fonts and third-party components
Typefaces and third-party components used on this site are used under their respective licences, which remain with their owners.
6. Availability, and what we do not promise
We work to keep this site available and accurate, but we do not guarantee that it will be uninterrupted, error free, or free of anything harmful. It is provided as it stands. We may change, suspend or withdraw any part of it, at any time, without notice.
Content here is general information about what we do. It is not professional, legal, financial or technical advice, and you should not act on it as though it were.
7. Links to other sites
This site links to services we do not run, including our booking calendar and our social profiles. We do not control those sites, we are not responsible for their content or their handling of your data, and a link is not an endorsement. Their terms and privacy policies apply once you arrive there.
8. Liability
To the fullest extent Spanish law allows, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data arising from your use of this website.
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Nothing in them affects the rights that mandatory Spanish consumer legislation gives a consumer.
9. If you are a consumer
We work almost entirely with businesses. If you engage us as a consumer rather than in the course of a trade or profession, Royal Legislative Decree 1/2007 (the Spanish consumer protection act) gives you rights that these terms cannot take away, including, for a contract agreed at a distance, a period of 14 days in which to withdraw. Where you ask us to begin work inside that period, and we do, you may still withdraw but you will owe us for what has already been done.
A complaint sent to horizonsymmetrystudio@gmail.com reaches us directly and is the fastest route to a resolution. You may also take a complaint to the consumer authorities of the Comunidad de Madrid.
10. Privacy and cookies
How we handle personal data is set out in our Privacy Policy. What this site does and does not store on your device is set out in our Cookie Policy. Both form part of these terms.
11. Changes to these terms
We may update this page. The version that applies to you is the one published when you use the site, so the date at the top is the one that counts. Material changes will be flagged on this page.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute arising from them or from the use of this website is subject to the courts of the city of Madrid, Spain, and both sides waive any other jurisdiction they might be entitled to.
This does not apply to a consumer, who keeps the right to bring proceedings in the courts of their own place of residence, and may only be sued there.
